1. Agreement to these terms
These Terms of Service ("Terms") are an agreement between you and Q Kyun ("we", "us", "our"), the operator of the Q Kyun queue management service. By creating a venue account, using the Controller or Mirror app, or using www.qkyun.co.in, you agree to these Terms.
"You" generally means a venue operator — a clinic, diagnostic centre, restaurant, salon, bank, or other business that signs up to run its queue on Q Kyun. Customers who take a token at a venue don't need an account and aren't required to accept these Terms directly, but Section 6 explains what that means for venue operators.
2. The service
Q Kyun is a position-based queue management system. Venues issue tokens by missed call, QR code, or reception entry; customers receive their token number and position by SMS and a recall alert when their turn is close. Venues manage the queue through a Controller app (for staff) and a Mirror view (for owners and doctors) as described on our homepage.
Q Kyun handles queue logistics only — it is not a medical device, a booking or appointment system, or a substitute for a venue's own scheduling, billing, or record-keeping systems.
3. Accounts & eligibility
- You must be at least 18 years old and authorised to act on behalf of the venue you're registering.
- You're responsible for the accuracy of your account and venue details, and for keeping your login credentials secure.
- You're responsible for activity carried out under your venue's account, including by your staff.
4. Plans, billing & the free pilot
Q Kyun is currently offered on the plans shown on our pricing page — a free 30-day Pilot, and paid Standard and Pro subscriptions billed per venue, per month. Plan features and prices may change; where they do, we'll give existing subscribers reasonable notice before a change takes effect on their next billing cycle.
Free Pilot
The Pilot plan is free for 30 days per venue, with the token, device, and feature limits shown on our pricing page. No commitment is required to start a Pilot. At the end of the Pilot, continuing to use Q Kyun requires moving to a paid plan.
Paid plans
Standard and Pro subscriptions are billed monthly per venue. You can cancel a subscription at any time; cancellation takes effect at the end of the current billing period, and we don't provide refunds for partial months except where required by law. Non-payment may result in suspension of queue-issuing features until the account is brought current.
We don't store your full card, UPI, or bank details — payments are handled by our payment gateway, as described in our Privacy Policy.
5. Acceptable use
You agree not to:
- Use Q Kyun for any unlawful purpose, or to harass, deceive, or defraud customers.
- Attempt to access another venue's account, data, or queue without authorisation.
- Interfere with the service's operation, including attempts to circumvent missed-call token limits or spam the SMS system.
- Reverse-engineer, resell, or white-label the Controller or Mirror apps without our written permission.
We may suspend a venue's ability to issue tokens if we reasonably believe the account is being used to misuse the missed-call system — the same blocking tool available to you from the Controller app is also available to us at the account level if abuse isn't addressed.
6. Your customers' data
When your venue collects a customer's mobile number to issue a queue token, you're responsible for making sure that customer knows they'll receive SMS messages from Q Kyun on your behalf, in line with applicable Indian telecom and data protection rules (including DLT/TRAI SMS regulations, where applicable to your venue).
For customer queue data (token numbers, positions, and phone numbers used for SMS), you act as the data controller and Q Kyun acts as a processor on your behalf, as described in our Privacy Policy. You're responsible for handling any customer request to access or delete their queue data that comes directly to your venue.
7. Service availability
We aim to keep Q Kyun available and reliable, but we don't guarantee uninterrupted or error-free service. SMS delivery depends on third-party telecom networks outside our control, and delivery times can vary. If the Controller device goes offline, the app will show a clear offline indicator and pause new token issuing until connectivity returns — it won't silently continue in a way that could mislead your queue.
8. Intellectual property
The Q Kyun name, logo, and the software behind the website, Controller app, and Mirror app are owned by Q Kyun or its licensors. These Terms don't transfer any ownership to you — you get a limited right to use the service for your venue's own queue management, nothing more.
Your venue's own configuration data (queue settings, SMS template text you write, venue name) remains yours; we just need it to run the service for you.
9. Third-party services
Q Kyun relies on third-party providers to work — an SMS gateway (MSG91) to deliver token and recall messages, a payment gateway to process subscriptions, and a cloud hosting provider. We're not responsible for outages or errors caused by these providers, though we'll work to route around persistent problems where we can.
10. Disclaimers & limitation of liability
Q Kyun is provided "as is," without warranties of any kind, express or implied, including as to availability, accuracy, or fitness for a particular purpose. Q Kyun shows queue position, not a guaranteed wait time — actual service time at your venue can vary for reasons outside our control.
To the maximum extent permitted by law, Q Kyun will not be liable for indirect, incidental, or consequential damages arising from use of the service, including lost revenue or lost customers at your venue. Nothing in these Terms limits liability that cannot be limited under applicable Indian law.
11. Termination
You can stop using Q Kyun and close your venue account at any time by contacting us — see our account deletion page. We may suspend or terminate an account that violates these Terms, misuses the platform, or has an unresolved billing issue, after reasonable notice where practical.
12. Governing law
These Terms are governed by the laws of India. Any dispute arising from these Terms or your use of Q Kyun will be subject to the jurisdiction of the competent courts of India.
13. Changes to these terms
We may update these Terms as Q Kyun evolves. The "Last updated" date at the top always reflects the current version. For material changes, we'll notify venue operators by email or in-app notice before the change takes effect. Continuing to use Q Kyun after a change takes effect means you accept the updated Terms.
